On March 11, 2019, I wrote this at Oakland News Now Blog: Victor McElhaney, the son of our beloved Oakland District Three Councilmember Lynette Gibson McElhaney, was killed in Los Angeles on Sunday, just after midnight. The person or persons who did this are still at large as of this writing. They must be found and brought to justice. According to reports, Victor McElhaney was in an area of Aams Boulevard and Maple Avenue, located east of the University of Southern California campus. ABC 7 LA wrote āPolice say several suspects approached the victim in what appears to be a robbery attempt, fired at him and then fled the scene in a vehicle. The shooting happened just after midnight. He was transported to a local hospital in critical condition and later died.ā CBS LA reports āAuthorities said the shooting occurred in a parking lot at Adams Boulevard and Maple Avenue around 12:30 a.m. Three or four men approached McElhaney demanding money. One of the men shot the victim.ā Now, how the LAPD came to know that āThree or four men approached McElhaney demanding moneyā is not known, but indicates that thereās a witness. Eventually, the killer, was found and apprehended. Ivan Hernandez, 29, pleaded no contest in January to first-degree murder in the March 10, 2019, killing of 21-year-old Victor McElhaney, whose mother was a member of the Oakland City Council. McElhaney was shot in the head just after midnight near Maple Avenue and Adams Boulevard and died at a hospital. The LA District Attorney reported the event in this way: District Attorney Nathan J. Hochman announced that a man pleaded no contest today to first-degree murder in the killing of University of Southern California student Victor McElhaney during an attempted robbery in March 2019. āThis no contest plea ensures that the individual responsible for the senseless and tragic murder of Victor McElhaney will face the consequence of his actions,ā District Attorney Hochman said. āVictor was a promising young 21-year old university student, a talented drummer and active member of USCās Center for Black Cultural and Student Affairs, whose life was cut short by an act of pure violence. Our office will aggressively seek accountability for those who threaten the safety of our communities, and we will not tolerate such heinous crimes.ā Ivan Hernandez (dob 12/7/95) also admitted he personally used a gun in case BA479107. The People are seeking a sentence of 35 years to life in prison. Sentencing was continued to April 30, 2025 in Dept. 104 of the Clara Shortridge Foltz Criminal Justice Center. McElhaney was taken to a nearby hospital where he died. The case was prosecuted by trial Deputy District Attorney Brian Kang of the Major Crimes Division, under the leadership of John McKinney, Director of the Bureau of Specialized Prosecutions, and Head Deputy Craig Hum. The case was investigated by the Los Angeles Police Departmentās Robbery-Homicide Division. That should not have happened to a young mad who was more than fulfilling his promise.
